1. Acceptance of Terms

By accessing or using the iSimplifyMe Intelligence platform at app.isimplifyme.com (the “Service”), operated by iSimplifyMe LLC (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

iSimplifyMe Intelligence is an AI-powered business intelligence platform that provides modules for chat assistance, CRM intelligence, AI visibility scanning, content generation, SEO analysis, reputation management, and social media management. The specific modules available to you depend on your subscription tier.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription Plans and Billing

Plans & Pricing

Plans: The Service is offered through paid subscription plans (Starter at $99/month, Growth at $399/month, and custom Enterprise plans). Each plan includes a monthly credit allocation and access to specific modules.

Free Trial: New subscribers may receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan.

Billing & Credits

Billing: Subscriptions are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. All fees are in U.S. dollars and are non-refundable except as required by law.

Credits: Each plan includes a monthly credit allocation that resets on the 1st of each month. Unused credits do not roll over. If you exhaust your credits, certain AI-powered features will be unavailable until your credits reset or you upgrade your plan.

Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until then.

5. Acceptable Use

You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to any part of the Service or its infrastructure; interfere with or disrupt the Service; reverse-engineer, decompile, or disassemble any part of the Service; use the Service to generate content that is harmful, misleading, or violates any applicable laws; share your account credentials with unauthorized users; or resell or redistribute the Service without our written consent.

6. AI-Generated Content

The Service uses artificial intelligence to generate content, analysis, and recommendations. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are solely responsible for reviewing, verifying, and editing all AI-generated content before use. We make no warranties regarding the accuracy, completeness, or fitness of AI-generated outputs for any particular purpose.

7. Intellectual Property

Our IP: The Service, including its design, features, code, and branding, is the property of iSimplifyMe LLC and is protected by intellectual property laws.

Your Content: You retain ownership of all business data and content you upload to the Service. By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service to you. AI-generated content created through the Service is owned by you.

8. Data Handling

Your data is handled in accordance with our Privacy Policy. We maintain strict multi-tenant data isolation, ensuring your business data is not accessible to other users or tenants. For healthcare clients requiring HIPAA compliance, we offer Business Associate Agreements upon request.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify you of planned maintenance in advance.

10. Limitation of Liability

To the maximum extent permitted by law, iSimplifyMe LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless iSimplifyMe LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney’s fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ceases immediately. Data retention following termination is governed by our Privacy Policy.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Cook County, Illinois.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
